About the app Odoma Tracker ("the app") is a free, non-commercial iOS and Android application for tracking driving trips and eco-driving behaviour. It is developed and maintained by **Odoma Digipädevuse Selts**, a non-profit association registered in Estonia (reg. no. 80659718), Tallinn, Harju maakond. The app is provided free of charge as a public-interest tool. There is no subscription, no premium tier, and no monetisation of user data. ## 2. Acceptance By installing or using the app, you agree to these Terms and to our [Privacy Policy](https://odoma.ee/en/legal/privacy). If you do not agree, do not use the app. These Terms apply to the iOS and Android applications and to the website at odoma.ee, including the Impact and Leaderboard pages. ## 3. Licence We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own personal or business trip tracking purposes. You may not: reverse-engineer, decompile, or disassemble the app; use the app or its API to build a competing product; scrape or bulk-download data from odoma.ee; or attempt to manipulate leaderboard rankings through automated or artificial means. ## 4. Your data Trip records, GPS traces, and all data generated by your use of the app remain yours. We do not claim ownership of your data. See the [Privacy Policy](https://odoma.ee/en/legal/privacy) for a full description of what is stored where and how to request deletion. ### 4.1 Receipt-recognition feedback If you choose to send receipt-recognition feedback (see section 3.3 of the [Privacy Policy](https://odoma.ee/en/legal/privacy)), you grant us a perpetual, irrevocable right to use that anonymous, redacted data to improve the recognition algorithms and related app features. Because such a submission is anonymous by construction, a specific submission cannot be withdrawn after the fact — it cannot be located, it is linked to nothing. Control over the transfer is exercised before it happens: the app shows a preview of exactly what will be sent, and you decide whether to send it or not. By sending feedback, you confirm that you have reviewed the preview and you undertake not to send receipts containing third parties' personal data beyond what automatic redaction removes. ## 5. Leaderboard Leaderboard participation is voluntary and opt-in. By enabling leaderboard sync in Settings, you agree to your anonymous aggregate metrics (eco score, trip count, streak, vehicle class, country code) being publicly visible on odoma.ee/leaderboard. You can remove your entry at any time by disabling leaderboard sync. Removal from the public leaderboard occurs within 7 days. We reserve the right to remove any entry that appears to be the result of manipulation, automated input, or misuse of the API. ## 6. Accuracy and reliance Eco scores, distance calculations, and CO₂ estimates are computed from GPS data and declared vehicle parameters. They are indicative only and should not be used as the sole basis for financial, insurance, legal, or regulatory decisions. GPS accuracy varies by device, environment (tunnels, urban canyons), and iOS or Android background processing conditions. Odoma applies filtering and compensation, but cannot guarantee that every trip is captured completely or accurately. Mileage reimbursement calculations (distance × rate) are provided as a convenience tool. You are responsible for verifying figures before submitting them to an employer or tax authority. Receipt recognition (vendor, amounts, VAT rate and amount, dates, receipt number, etc.) is performed automatically and is indicative only. Before relying on the recognised data for accounting, tax, or any other purpose, you must check it against the original receipt. We are not liable for the consequences of relying on incorrectly recognised data. ## 7. Disclaimer of warranties The app is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of security vulnerabilities. To the maximum extent permitted by applicable law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. ## 8. Limitation of liability To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including lost data, missed trips, or incorrect mileage figures. Our total aggregate liability to you for any claim arising out of or relating to these Terms or the app shall not exceed €100. ## 9. Governing law and disputes These Terms are governed by the laws of the Republic of Estonia. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia, except where mandatory consumer protection law in your country of residence requires otherwise. EU residents also have the right to use the European Commission's Online Dispute Resolution platform at [ec.europa.eu/consumers/odr](https://ec.europa.eu/consumers/odr). ## 10. Changes to these Terms We may update these Terms as the app evolves. Material changes will be noted in the app release notes and on this page with an updated effective date.
